2021-22 NLL Pick ‘Em Rules

PLEASE READ CAREFULLY THE FOLLOWING OFFICIAL RULES. BY REGISTERING FOR, ACCESSING, BROWSING, OR USING THE SITE AND/OR PARTICIPATING IN THE GAME, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE FOLLOWING RULES, INCLUDING ANY ADDITIONAL GUIDELINES AND FUTURE MODIFICATIONS (COLLECTIVELY, THE “TERMS”). IF AT ANY TIME YOU DO NOT AGREE TO THESE TERMS, PLEASE IMMEDIATELY TERMINATE YOUR USE OF THE SITE AND PARTICIPATING IN THE GAME.

NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

Administrator: National Lacrosse League, Inc. (“NLL”) will serve as the administrator (the “Administrator”) of the Contest and will be responsible for resolving any disputes that arise regarding violations of the rules.

Entry Period: The NLL 2021-22 Pick ‘Em Challenge (the “Contest”) commences at 12:01 AM ET on Monday, November 22, 2021, and ends at 11:59 PM ET on April 29, 2022 (the “Contest Period”). The Contest will consist of 21 weeks of play coinciding with the 2021-22 NLL Regular season. All entries must be received 15 minutes prior to the face off of the first game during a given week. All interpretations of these Official Rules and decisions made relating to the Contest are final.

Eligibility: The Contest is open only to legal residents of the United States and Canada who are at least 13 years of age at time of entry (“Eligible Contestants”). By participating in this Contest, entrants: (a) agree to be bound by these Official Rules and by the interpretations of these Official Rules by Administrator and by the decisions of Administrator; (b) acknowledge compliance with these Official Rules; (c) agree to comply with any and all applicable federal, state and local laws, rules and regulations; and (d) agree to release and hold harmless the NLL, its Member Clubs and their respective partnerships, partners, principals, officers, directors, owners, shareholders, other officials, employees, affiliates and other related entities, servants, agents, representatives, successors and assigns (collectively, the “Contest Entities”) from and against any and all claims, injury or damages arising out of or relating to participation in Contest and/or the use, misuse or redemption of the Prizes (as defined herein), and for any claim including claims based on defamation, publicity rights, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property related cause of action.

Contest Overview: During the Contest Period, Eligible Contestants must register a profile at nllpickem.com and submit picks for all ten (10) questions each week. Eligible Contestants may enter one (1) time per week for the chance to win Prizes. The Contest will consist of 21 playable weeks. Eligible Contestants may not win more than one weekly Prize during the Contest Period. There are three (3) different question types which are predicated on the result of prospective NLL game events. Binary questions will have an associated point value of ten (10) points. Multiple choice questions will have a point value of twenty (20) points. Slider questions will have a varied point value based on the difficulty of the question ranging from thirty (30) points to one hundred (100) points. There will be a minimum of three (3) slider questions per week.

To Enter: There is one (1) method of entry: Eligible Contestants must cast their choice via the Pick ‘Em widget and submit via nllpickem.com after either registering their account or logging into their account. Eligible Contestants may play one (1) time per week of the NLL Regular Season, which is Monday through Sunday each week during the Contest Period for the chance to win Prizes. Eligible Contestants may not win more than one weekly Prize during the Contest Period, but may continue to be eligible for the season long Prize and the weekly cash Prize, as further described herein. The odds of becoming a Winner is based on the total number of eligible entries received by the contest period’s end.

Prizes: Eligible Contestants will be eligible to win one of the following prizes:

  • If an Eligible Contestant answers every question correctly for a given week, they will win a $10,000USD cash prize (the “Cash Prize”). If there are multiple Winners, the winnings will be divided by the number of winning Eligible Contestants (each, a “Cash Prize Winner”). The cash prize is available for each of the 21 playable weeks.
  • The Eligible Contestant who accumulates the most points each week based on the number and type of questions answered correctly will win an NLL jersey of their choice (ARV: $90USD) (the “Weekly Prize”).
  • The Eligible Contestant who accumulates the most total points during the entire Contest Period will win a trip to an NLL Playoff Game mutually agreed upon by NLL and the winning Eligible Contestant. The trip will include two (2) roundtrip airfare tickets (up to a maximum $400 per ticket), two (2) nights in one (1) hotel room selected solely by NLL, and two (2) tickets to an NLL Playoff Game during the 2021-22 season (ARV: $1,000) (the “Cumulative Prize”, and collectively with the Cash Prize and Weekly Prize, “Prizes”).

Winner Selection and Notification: There will be one (1) selected Winner for each week of games from the 2021-22 NLL Regular Season from among all of the Eligible Contestants throughout the Contest Period for each weekly Prize (a “Weekly Prize Winner”).

There will be one (1) Winner designated as the Eligible Contestant who has accumulated the most points throughout the entirety of the Contest Period (the “Cumulative Prize Winners”, and collectively with Cash Prize Winners and Weekly Prize Winners, “Winners”). The Cumulative Prize Winner will be contacted within one business day of the end of the Contest Period. Weekly Prize Winners and, if applicable, Cash Prize Winners will be contacted the Monday following each respective NLL week. Administrator will attempt to contact the potential Winners via the email address provided at time of entry.  If the selected Winner fails to respond to the Administrator by the date and time specified by Administrator, after two (2) attempts to contact a Winner, the potential Winner will be disqualified and an alternate potential Winner will be selected in accordance with these Official Rules.

Winner Verification: The potential Winner may be required to prove eligibility, including, without limitation, proof of age, residence and identity, which may include submitting a copy of a driver’s license, passport or similar government issued identification within one (1) day of being notified of being a potential Winner. In the event of non-compliance by a potential Winner, such potential Winner shall be disqualified and all privileges otherwise due as a Winner shall be terminated and an alternative potential Winner will be chosen in a random drawing from among all of the remaining applicable Eligible Contestants participating in the Contest. Administrator expressly reserves the right to delay the announcement of the Winner for any reason Administrator deems necessary. In addition, Administrator reserves the right to select an alternative Winner in the event that any potential Winner fails to comply with these Official Rules. By participating in the Contest, the Winner acknowledge that the Contest Entities have not and will not obtain or provide insurance of any kind relating to the Prizes and that Winner (or any parent or legal guardian acting on behalf of a Winner) will be responsible for obtaining and paying for any life, travel, car, accident, property or other form of insurance relating to the Prizes that Winner deems appropriate.

Prize Terms: The dates for fulfillment of the Weekly Prizes and, if applicable, the Cash Prize(s) will be July 31, 2022, but is subject to change in Administrator’s sole discretion. If for any reason any Prize is unavailable or any Prize or related event is delayed, cancelled or postponed, or for any other reason, Administrator reserves the right to modify the Contest and the Official Rules in its sole discretion and award a substitute Prize, or portion of a Prize, of comparable or greater value as set forth in these Official Rules. No substitution, transfer, assignment or cash equivalent of the Prize, or any portion thereof, is permitted by a Winner. Contest Entities shall have no responsibility or obligation to a Winner who is unable or unavailable to, or who does not for any reason, accept or utilize a Prize. All costs and expenses not specifically listed above as part of the Prize, including, without limitation, transportation, meals, snacks and beverages are solely Winner’s responsibility. NLL shall not be responsible for any unforeseen expenses incurred by Winner in the course of accepting or using a Prize. Prizes are provided “as is”. Each entrant acknowledges that the Contest Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prizes, including any express warranties provided by a Prize supplier that are sent along with the Prizes and any implied warranty of merchantability of fitness for a particular purpose. Arrangements for the fulfillment of the Prizes will be made by Administrator.

All Weekly Prizes will be sent via USPS, FedEx or similar. Administrator will make appropriate arrangements with the Cumulative Prize Winner and any Cash Prize Winner, if applicable.

NLL is not responsible for the condition of the Prize upon delivery.

Limitation of Liability and Disclaimer of Warranties: IN NO EVENT WILL THE CONTEST ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE CONTEST, OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE CONTEST. IN NO EVENT SHALL NLL’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED ONE HUNDRED DOLLARS (US$100.00). WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE CONTEST IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

Binding Arbitration: The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Contest. Any controversy or claim arising out of or relating to these Official Rules and/or the Contest shall be settled by binding arbitration in accordance with the commercial arbitration rules of JAMS in accordance with the JAMS Comprehensive Arbitration Rules and Procedures, as modified by the JAMS Consumer Arbitration Minimum Standards. Class arbitrations and class actions are not permitted under any circumstances. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the Commonwealth of Pennsylvania, in the City of Philadelphia.

Governing Law and Jurisdiction: THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE COMMONWEALTH OF PENNSYLVANIA WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. FOR ANY MATTERS WHICH ARE NOT SUBJECT TO ARBITRATION AS SET FORTH IN THESE OFFICIAL RULES AND/OR IN CONNECTION WITH THE ENTERING OF ANY JUDGMENT ON AN ARBITRATION AWARD IN CONNECTION WITH THESE OFFICIAL RULES AND/OR THE CONTEST, THE PARTIES IRREVOCABLY SUBMIT AND CONSENT TO THE EXCLUSIVE JURISDICTION AND VENUE OF THE PENNSYLVANIA STATE AND FEDERAL COURTS LOCATED IN THE CITY OF PHILADELPHIA, AND COMMONWEALTH OF PENNSYLVANIA. THE PARTIES AGREE NOT TO RAISE THE DEFENSE OF FORUM NON CONVENIENS.

Additional Terms: The Administrator reserves the right, at its discretion, if required, to cancel, terminate, modify or suspend this Contest, in whole or in part, if for any reason the Contest is not capable of running as planned, including for tampering, unauthorized intervention, fraud or any other cause beyond the control of Administrator which in the opinion of Administrator affects the administration, security, fairness, integrity or proper conduct of this Contest. All decisions of the Administrator or those of its representatives regarding this Contest are final and binding, subject to any decision by a court of competent jurisdiction or by the conflict resolution procedure as described herein. This Contest is not available to residents of the Province of Quebec.
